SIX MONTH FULL PARTS REPLACEMENT WARRANTY
Christie's Limited Trading as SHINERAY MOTORCYCLES hereby undertake to guarantee this motorcycle or generator to be free from defects in material and/or workmanship for the 6 month period of the warranty.
For the first 6 months service intervals at periods of 1,3 and 6 months need to be adhered to and carried out (at the purchasers expense) at a Service Centre Authorized by SHINERAY MOTORCYCLES for the warranty to be kept valid.
Subject to the terms and conditions set forth herein, SHINERAY MOTORCYCLES will reimburse you up to the "Limits of Liability," stated herein, for the reasonable replacement parts required to repair or replace the failed covered component(s).
The labour cost of a repair or replacement is not covered by this warranty. At SHINERAY MOTORCYCLES option, damaged parts may be replaced with used, rebuilt, remanufactured or new parts. When the cost of a repair for parts and labour exceeds the cost of replacing the failed part/component, SHINERAY MOTORCYCLE reserves the right to authorize an amount based on used, rebuilt or remanufactured parts not to exceed the liability limits within this Guarantee.
COMPONENT GROUPS COVERED BY THIS WARRANTY
ENGINE: All internal lubricated parts including: camshaft and bearings; connecting rods and bearings, crankshaft and main bearings; internal reed valves (where fitted); oil pump; push rods and lifters, pistons, piston rings and pins; rocker arms, shafts and bushings; internal timing gears and chains; valve guides. Engine head(s), engine block and cylinder barrels are covered only if damage is caused by failure of an internal, lubricated covered part. Seals and gaskets are covered only when replaced during covered repairs. FUEL DELIVERY: Fuel tank; mechanical fuel pump; petcock; metal fuel lines and fittings. External parts, electronic and non-lubricated parts are not covered.
TRANSMISSION: All internal lubricated parts contained within the transmission case; all gears; bearings; internal drive gears and chains; internal selector mechanism. Transmission case is covered only if damage is caused by the failure of a covered internal, lubricated transmission part. (CLUTCH ASSEMBLY is not covered.)
PRIMARY & SECONDARY DRIVES: All internal lubricated parts contained within the primary case; all gears; bearings; internal drive gears and chains; internal selector mechanism. Primary case is covered only if damage is caused by the failure of a covered internal lubricated primary/secondary drive part. (CLUTCH ASSEMBLY, DRIVE CHAIN, and DRIVE CHAIN SPROCKETS are not covered.)
FINAL DRIVE: (Shaft Driven Models Only): All internal lubricated parts contained within the drive shaft and final drive housing. Drive shaft and final drive housing are covered only if damage is caused by the failure of an internal lubricated final drive part. FINAL DRIVE CHAINS/BELTS or SPROCKETS, or consequential damages due to chain breakage are not covered.
EXCLUSIONS
1. Pre-existing damage to the covered parts listed or damage caused by accident (collision), overheat, fire, misuse, negligence, acts of God (lightning, fire, flood, freeze, etc), manufacturer design faults, or failure to perform required servicing, or improper installation of a covered part/component.
2. Bolts and fasteners, fluids, shop supplies, hazardous waste disposal, maintenance items, adjustments, alignments, tune-ups, diagnostics, seals and gaskets resulting in fluid leaks, piston seizure or erosion and freight.
3.. Emergency vehicles, vehicles used for commercial or delivery purposes, racing competition, or
specifically designed for the purpose of racing and vehicles modified from manufacturer's specifications.
4. Any loss if the odometer has stopped, is tampered with or altered in any way, or the actual mileage cannot be determined if YOUR vehicle is produced with an odometer as original equipment, the Warranty shall become void.
5.Consumable items such as battery, fuses, light bulbs, lens and reflectors, cables, spark plug, breaker points tappet shims, seals, bearings and gaskets, air cleaner elements, chains, rims, spokes, tyres, tubes, brake linings and fluids, plastics, fairings and other rubber parts.
6. Lubricants - Oil, grease, battery electrolyte, radiator coolant and other items specified by SHINERAY MOTORCYCLES.
Cleaning, inspection, adjustment and other periodic maintenance items.
7. Expenses incidental to the warranty claim, including:
- Additional expenses incurred for communications, lodging, meals and other items due to breakdown of the product in a remote area.
- Compensation for loss of time, commercial losses or rental costs for a substitute product during the period of adjustment.
8. Parts replaced due to normal wear or routine maintenance
9. Motorcycles used in hire or rental activities and in competition (eg Racing and jumping)
10. Failure or damage of ay component resulting from the operation of the motorcycle after the owner (operator) knows or has cause to know that the machine is defective in any way.
TERM - LIMITS OF LIABILITY
SHINERAY MOTORCYCLES total liability (all claims paid and payable) shall not exceed the lesser of: a). the actual cash value of your vehicle at the time of failure; or b) $1,500.00. Any claim payment under this Guarantee is subject to the lesser of the costs of repairs or replacement.
TRANSFER
Warranties on this product apply to the purchaser only and is not transferable to any new or subsequent owner.
CLAIMS PROCEDURE
In the event product failure, follow these instructions:
Your vehicle may be repaired at any licensed repair facility of your choice.
Failed or damaged parts must be returned to SHINERAY MOTORCYCLES at owner’s expense for assessment by our engineers. Approved claims will be processed within 48 hours of receipt and replacement parts will be sent directly to your nominated licensed repair centre.
It is your responsibility to have the failure properly diagnosed. You are responsible for authorizing the inspection and tear down by the repair facility, but only to the point where the damage is visible or cause determinable. Repairs not authorized by SHINERAY MOTORCYCLES will not be accepted.
SHINERAY MOTORCYCLES reserves the right to inspect your vehicle prior to authorization.
REPRESENTATIONS
This Guarantee provides coverage only in New Zealand for losses due solely to failure of a part listed in the COMPONENT GROUPS COVERED section listed in this Guarantee. This Guarantee is the entire understanding between you and SHINERAY MOTORCYCLES and there are no warranties, representations or agreements that are not expressly set forth herein. None of the terms or conditions of the Guarantee may be changed, waived or modified. This Guarantee may be declared VOID in the event of any material misrepresentation, fraudulent claim(s) and/or action(s) or if the Guarantee is not accepted by SHINERAY MOTORCYCLES . This Guarantee does not constitute a written affirmation of fact or promise by SHINERAY MOTORCYCLES that the material or workmanship of your vehicle or any parts thereof is free of any defects or will meet a specified level of performance over a period of time. This Guarantee constitutes the entire SHINERAY MOTORCYCLES guarantee and any promises otherwise made by the seller of SHINERAY MOTORCYCLES are null and void.
This SHINERAY MOTORCYCLES manufactures warranty is provided in addition to any statutory guarantees that may apply by virtue of the Consumer Guarantees Act 1993. The limitations and exclusion provisions stated herein apply to the SHINERAY warranty. Any statutory guarantees will be subject to the exceptions, qualifications and limitations as set out in the Consumers Guarantees Act 1993 (New Zealand) and in particular where the warranty relates to the purchase of a motorcycle or generator for business purposes the provisions of the Consumers Guarantees Act 1993 will not apply. |
